Amid all the patent litigation in the wireless market, most of it clearly driven by commercial tactics, European and US antitrust regulators are increasingly concerned that patents are being used instead of innovation and fair competition to fight off rivals. The Federal Trade Commission is taking a close look at the use of ‘standards essential’ patents in the smartphone IPR wars, the agency’s chairman Jon Liebowitz said last week. ‘That’s an area that the Commission is enormously concerned about,’ he said at the All Things Digital conference, perhaps signalling willingness to mount a formal probe.
